MENAC has extended the deadline for registration on the RGPC Platform (General Regime for the Prevention of Corruption) and submission of information on compliance with the regulation to February 14, 2025.
MENAC (Portuguese National Anti-Corruption Mechanism) is the entity with competences over the planning of control and supervision of the RGPC, approved as an annex to Decree-Law No. 109-E/2021, of December 9, in force since June 7, 2022.
Entities under scope
- Legal entities with head office or branch in Portugal that employ 50 or more workers; and
- Services and legal entities of the direct and indirect administration of the State, the Autonomous Regions, local authorities and the public business sector that employ 50 or more workers.
Obligations
Covered entities must adopt and implement a compliance program, which includes:
- Plan for the prevention of risks of corruption and related infractions (PPR)
- Code of conduct
- In-house training program
- Provision of a whistleblowing channel
- Designation of the regulatory compliance officer
In November 2024, MENAC made available the “RGPC Platform”, a mandatory registration tool for entities subject to the regime. This registration must now be completed by February 14, 2025 and involves providing information regarding the aforementioned obligations, for analysis of compliance with the regulation.
Compliance with the regulations is mandatory, and the entities covered are subject to administrative offence liability.
